3DS Frequent error message and freezing.

Hello.

 

So I received a refurbished midnight purple 3DS straight from nintendo and it's been causing me problems.

 

I got the console on 12/9/13 but I only just got my first game for it which was Monster Hunter 3 Ultimate a few day ago. Before then I would occasionally get the message "An error has occurred forcing the software to restart" when I did anything from being on the camera app to playing on Mii Plaza but it would only pop-up once or twice

 

I would also get the same error while playing demos but again I never spent long enough playing a demo to get the error more then maybe twice. Infact today I downloaded the Bravely Default demo and after about an hour of play the error popped up.

 

Now that I have my first game and I notice how big of a problem this is. The first day I played I got that same message about 5 or 6 times and the game froze completely with no error messages or anything twice. It is completely random I can be playing for 2 hours and get it or 5 minutes and have it happen.

 

I have tried everything I can do fix it including getting a new SD Card,Reformatting both SD cards and doing a factory system reset,playing with the wi-fi off about everything I can do on my end I feel I've done.

 

I called Nintendo today and was told to basically just wait and see if it got better. I intend to call them back later to see if I can get some help. I guess that is all I can really do but has anyone else ever had an issue like this?

 

Also my 3DS gets warm when I play sometimes,is that normal? I've heard both yes and no from people but I forgot to mention it when I called in.
